Terms of Service

These Terms of Service (“Terms”) form a legally binding agreement between you and Prevue (“we,” “us,” or “our”) governing your access to and use of the Prevue platform at prevue.io and any related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use the Service. If you are between 13 and 18 years old, you may only use the Service with the consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements and have the legal capacity to enter into a binding agreement.
The Service is intended for photographers, photo editors, creative directors, and other visual creatives. Use of the Service for any purpose unrelated to creative image evaluation is prohibited.
2. Account Registration
To access most features, you must create an account using a valid email address or supported OAuth provider (Google, GitHub). Authentication is provided by Clerk. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to provide accurate and complete information at registration and to keep your account information up to date. You may not use another person’s account or impersonate any individual or entity.
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for more than 24 consecutive months.
3. Subscriptions & Billing
Important: Auto-Renewal Disclosure
Paid subscriptions (Creator, Team, Studio) automatically renew at the end of each billing period (monthly or annual) at the then-current price. You authorize us to charge your payment method on file for each renewal. You will receive an email reminder before any annual renewal. To cancel, you must do so before the renewal date through your account settings or by contacting us. Cancellation takes effect at the end of the current billing period — you will not be charged again after cancellation but you will retain access until the period ends.
Free Plan: The Free plan is provided at no charge and is subject to usage limits described on our Pricing page. We reserve the right to modify Free plan limits with 30 days’ notice.
Price Changes: We may change subscription prices with at least 30 days’ written notice. Price changes take effect at your next renewal date after the notice period.
Founding Member License: A Founding Member purchase is a one-time payment for lifetime access at the Creator level, offered for a limited time and a limited number of seats. Your license covers Creator-class features and their natural evolution, for the life of Prevue — future Team and Studio tiers are separate. The standard 14-day refund policy applies; a refunded license is revoked and its seat returns to the available pool.
Refunds: Subscription fees are generally non-refundable. If you believe you have been charged in error, contact us at legal@prevue.io within 14 days of the charge and we will review your request.
Taxes: Prices are exclusive of applicable taxes. You are responsible for all sales, use, VAT, GST, or other taxes applicable to your purchase based on your jurisdiction.
4. Your Content — Ownership & License
You retain full copyright and all other intellectual property rights in the images and content you upload to the Service. We do not claim any ownership interest in your content.
By uploading content to the Service, you grant Prevue a limited, non-exclusive, worldwide, royalty-free license to:
- Store, host, and serve your images to you and your designated collaborators;
- Process your images through our ranking algorithms to generate evaluation data;
- Apply watermarks to images you submit to The Current (see Section 5);
- Display watermarked images to The Current community evaluators for ranking purposes only;
- Generate thumbnails and optimized versions for display within the Service.
This license terminates when you delete the applicable content from your account or close your account. We do not use your images to train machine learning or generative AI models.
You represent and warrant that: (a) you own or have the necessary rights to upload and use each image; (b) your content does not infringe any third party’s intellectual property rights, privacy rights, or other legal rights; and (c) you have the right to grant the license above.
5. The Current — Community Evaluation Pool
The Current is an opt-in feature that submits your watermarked images to a community pool where other platform users and anonymous visitors evaluate and rank them alongside other photographers’ work.
Consent required: Participation in The Current requires your explicit consent at the time of submission. You may withdraw your images from The Current at any time through your session settings. Withdrawal removes your images from future evaluation queues; historical ranking data generated before withdrawal is retained in aggregate and anonymized form.
Watermarking: All images displayed in The Current are watermarked with a visible Prevue identifier before being shown to evaluators. Your original, unwatermarked file is never shared with other users or evaluators.
Evaluator conduct: Evaluators who view images in The Current are bound by these Terms and may not: screenshot, download, or reproduce images; attempt to remove or obscure watermarks; use images for any purpose other than providing ranking feedback; or attempt to identify the photographers behind submitted work.
No editorial relationship: The Current is a statistical ranking tool. High ranking in The Current does not constitute endorsement, publication, or any editorial selection by Prevue.
6. Shared Sessions & Collaboration
You may share evaluation sessions with collaborators or publish results via a unique share link. When you share a session:
- Anyone with the share link can view results or (if configured) participate in evaluations;
- Evaluator comparison choices contributed via a share link are stored and incorporated into your session rankings;
- You control whether a share link is active and can revoke it at any time from your session settings.
You are responsible for how you distribute share links. Do not share links to sessions containing sensitive content with people who are not authorized to view it.
7. Acceptable Use
You agree not to use the Service to:
- Upload images you do not own or have the right to use;
- Upload adult, sexually explicit, or NSFW content of any kind;
- Upload content that depicts minors in any inappropriate or sexualized manner;
- Upload content that promotes hatred, violence, or discrimination;
- Misrepresent AI-generated images as original photography;
- Attempt to reverse-engineer, decompile, or extract the ranking algorithm or any other proprietary technology;
- Circumvent, disable, or interfere with security features of the Service;
- Use the Service in any manner that violates applicable laws or regulations;
- Scrape, crawl, or systematically extract data from the Service without our written permission;
- Use the Service to compete with Prevue by offering substantially similar services.
We reserve the right to remove any content that violates these rules and to suspend or terminate the accounts of users who engage in prohibited conduct, without prior notice.
8. Algorithm & Results Disclaimer
Rankings generated by Prevue are based on the Bradley-Terry pairwise comparison model applied to evaluation data you or others provide. Rankings represent a statistical aggregation of evaluator preferences and are not a guarantee of commercial viability, artistic merit, or any editorial judgment by Prevue. We disclaim all responsibility for decisions you make based on Prevue rankings.
9. Intellectual Property — Platform
All platform technology, design elements, algorithms, software (excluding your uploaded content), trademarks, and the Prevue brand are owned by Prevue and protected by intellectual property law. You may not copy, modify, distribute, sell, or lease any part of the Service or its underlying technology.
10. Privacy
Our Privacy Policy describes how we collect, use, and protect your personal data. By using the Service, you agree to our Privacy Policy.
11. Termination
By you: You may close your account at any time in your account settings. Closing your account cancels your subscription at the end of the current billing period and initiates deletion of your personal data within 30 days.
By us: We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms or if we are required to do so by law. We may also discontinue the Service with 60 days’ notice.
Upon termination, all provisions that by their nature should survive (including ownership, warranty disclaimers, indemnity, and limitations of liability) will survive.
12. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted access. We do not warrant that the Service will be error-free, that defects will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components.
13. Limitation of Liability
To the maximum extent permitted by applicable law, in no event will Prevue, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages — including without limitation loss of profits, loss of data, loss of goodwill, or business interruption — arising out of or in connection with your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) $100 USD.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of certain liabilities. If these laws apply to you, some of the above exclusions may not apply and your rights may be broader.
14. Indemnification
You agree to indemnify, defend, and hold harmless Prevue and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the Service in violation of these Terms; (b) your content, including any claim that your content infringes third-party rights; or (c) your violation of any applicable law.
15. Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles.
Any dispute arising from or relating to these Terms or the Service that cannot be resolved informally will be resolved through binding individual arbitration under the rules of the American Arbitration Association. You waive the right to participate in any class-action lawsuit or class-wide arbitration.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect intellectual property rights.
16. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or in-app notification at least 14 days before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service before the effective date.
17. Miscellaneous
Entire Agreement: These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Prevue regarding the Service and supersede all prior agreements.
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
Waiver: Our failure to enforce any provision of these Terms will not be deemed a waiver of our right to do so later.
Assignment: You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.
